OSHA Reporting Requirements: Always Evolving

Kentucky employers -- especially those with comparatively high rates of worker illnesses and injuries -- know that the Occupational Health and Safety Administration (OSHA) is anything but a passive, hands-off regulator. Kentucky operates its own OSHA-approved state plan, the Kentucky Occupational Safety and Health Program (KYOSH).

Employers in widely diverse industries deal routinely with OSHA mandates relevant to workplace safety, accident/injury reporting and related matters. OSHA officials establish and enforce standards, weigh in on compliance issues, set up training programs, conduct inspections and issue fines and other penalties.

Many employers in Kentucky and nationally needed to recently take heed of new reporting requirements that took effect December 15, regarding reporting of illnesses and injuries. Employers with 250-plus workers currently required to maintain such records on site must now electronically report. Additionally, companies having a workforce between 20-249 workers must also now send reports to an agency website via a special tracking tool, if they are in certain industries deemed to have elevated safety risks. OSHA recently announced that it would continue to accept written reports through midnight December 31, 2017. Details on the new requirements may be found at https://www.osha.gov/injuryreporting/.

OSHA  will phase in reporting duties over a two-year period and perhaps still tweak some provisions or even remove them outright.

Given that element of flux and possible adjustment, employers should OSHA or legal counsel with any questions regarding the new reporting requirements.
